No LICENSE Required to play at weddings

In a much awaited move, the Copyright Office, Ministry of Commerce & Industry has upheld the demand of the industry to exempt the Wedding functions from obtaining licenses for playing recorded or live music. Earlier there was ambiguity in the matter and that was causing a lot of confusion for the event managers across the country.

PPL, IPRS, NOVEX and few other companies are in the business of issuing licenses for use of copyright music of companies that are affiliated to their organisation. After receiving representations from various stake holders, seeking clarification whether a license is required to be obtained for a wedding related function, the Copyright Office deliberated upon the matter and went through Copyright Act, 1957.

It concluded that in view of the provision contained in section 52(1)(ZA) of the act, read with the explanation thereto, it is evident that the utilisation of any song recording in the course of religious ceremony, including a marriage procession and other social festivities associated with a marriage does not amount to infringement of copy rights and hence no license is required to be obtained for the said purpose.

The notification has come well in time, before the wedding season kicks in. Lets hope that all the Baraatis will dance their shoes off to the tunes of the latest Bollywood Numbers! With the concept of performances by the immediate family members and friends, catching up, this move will further heighten the pleasures of the BIG Indian Wedding. Wedding Planners, Event Managers, Wedding Choreographers, Wedding Photographers can finally breathe a sigh of relief because, finally, Music to the ears – No Music License required
